1- These are the terms and conditions which apply to all transactions through this website between you, the customer, and us, Ultracomida Trading Co Ltd, trading as Spanish Wines Online, registration number 07239212, VAT number 994365960, registered in England and Wales.

2- When you place an order, we will send you an email to acknowledge that we have received your order. This email does not constitute acceptance of your order. We will need to verify your payment details and process your order. We will send you an email notifying you that the goods have been dispatched. This will constitute our acceptance of your offer to buy, and a binding contract will be formed at that point.

3- Goods are subject to availability. Publication on this website does not constitute an offer for sale.

4- All our products are artisan-produced. Weights given on the website are an approximate guide only.

5- The prices shown are for the goods only and do not include delivery charges. These will be added to your total during the ordering process. Where VAT is payable, it is included in the price of the product. (See our delivery policy for more details on delivery charges and locations, included at the end of these terms and conditions for your convenience).

5i - We deliver to the majority of Mainland UK - please see our delivery policy stated below. If your location isn't mentioned please feel free to email us to enquire.

6- We do our best to ensure that all prices on our website are accurate. However, if it should be discovered that there is an error in the price of the goods you have ordered, we will contact you as soon as possible. You have the option at that point of either continuing with your order at the amended price, or of cancelling the order. If ever your card is charged in error, we will refund your money promptly.

7- We aim to dispatch all orders within 2 working days. If we are unable to dispatch your order within 7 days, we will contact you with an estimated dispatch date, and give you a choice of cancelling your order at that point.

8- We cannot be held responsible for the condition of the goods if no one was at the delivery address, and the goods could not be delivered. You are responsible for ensuring that the delivery address details are correct, and that you have provided the correct postcode. Please see our delivery policy for further details on delivery.

9- When purchasing wine from us, the vintage listed on the website is provided for information purposes only, we are not able to guarantee that you will receive the listed vintage in all cases. If you require a specific vintage please contact us directly to discuss availability.

10- Age Restricted Products – Our wines, beers and spirits are only sold to customers over the age of 18. By placing an order, you confirm that you are at least 18 years old. If you are buying alcohol as a gift, the recipient must be over 18 as well, and by placing an order, you confirm this fact. We may refuse an order at our discretion if we have concerns about the age of the buyer or the recipient.

11- Cancellation Policy – If you wish to cancel your order, you will need to contact us by phone or by email. Please see the Contacts page for these details. In the pursuit of good service, we process orders as quickly as possible, and may not be able to stop an order
from being dispatched. If your order has already been dispatched, you may return the items to us in accordance with our Returns Policy (see below).

12i- Returns Policy - Perishable Goods: Returns are accepted only if the goods are damaged. You must contact us no more than 24 hours after receipt. You will need to return the item in its original, complete packaging. If the item has not been returned to us in its original condition we may refuse to accept the return. The original delivery documents will also need to accompany the goods, along with a receipt for the postage paid for returning the goods, if we are to issue a refund.  In the event of breakages we will refund all damaged items. Please see our Contacts page for details on how to contact us. These terms do not affect your statutory rights as a consumer, or your right to return non-perishable goods under the Consumer Contracts Regulation.

12ii- For non-perishable goods, you have a right to return them during the cooling-off period of 14 days, regardless of the condition of the goods. You will still need to follow the above requirements of returning the item in its original, complete packaging. 

13- All confidential information, including credit card details, is held securely and is only transmitted in encrypted form. Customer details are not passed to third parties and are used only in accordance with the Data Protection Act.

14- We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of our sub-contractors or suppliers, is consequential, or was not reasonably foreseeable to both you and us when the contract between us was formed. Our liability to you under these terms and conditions will not exceed the total price charged for the items purchased.

15- These terms and conditions are governed by the law of England and Wales. The parties to the contract agree to submit any dispute that arises from this agreement to the courts of England and Wales.

16- We reserve the right to make changes at any time to this website, these terms and conditions, our Privacy Policy and any other such policies of which we may inform you.                                                                  

17- 'Best Before' Dispatch Policy - All procudts are dispatched within their best before or use by date. Fresh goods will have a minimum expiry date of two weeks from dispatch and bottled or tinned goods of one month. If you require a longer window before expiry, please ask in advance.

18- Paying in a minimum of £20 per month on to your account balance (under the tab Account Funds) will automatically qualify you for a free bottle of wine of our choosing. This will appear in your basket as a free product. It will stay in your basket, to be claimed by purchasing 11 or more bottles on your next order. If unclaimed, after a two week period the free bottle will be removed so that we can update your account for the next free bottle upon the next payment of £20 on the following month.

We use a courier service to send your goods to you. For Mainland England, Wales and the Lowlands of Scotland, it is a next working day delivery service. For most of the Highlands of Scotland and for non Mainland UK, it is a minimum two-day service. Our packaging is designed for 24-hr delivery so for refrigerated goods we cannot guarantee that they will still be in optimum condition after two days in transit. We would suggest, therefore, that customers in this area choose from the non-perishable selections. Prices are affected by a number of factors, please consult our Delivery Policy or wholesale documents for further information. 

Our service does not require a signature to acknowledge delivery. A box is provided during the checkout process where you can tell us where to leave the goods if no-one is in at the time of delivery. If this information has not been provided, and the driver is unable to deliver the goods or if anything happens to the goods in the time it takes you to collect them from your safe place, we cannot be held responsible for the condition of the goods. You are responsible for ensuring that the delivery address details are correct, and that you have provided the correct postcode.

Delivery is only on working days, therefore orders are usually dispatched Monday – Thursday (Monday -Wednesday for the Highlands of Scotland), as we do not want refrigerated goods to sit in our courier’s warehouse over the weekend.

Maximum delivery weight is 30kg.

PRICES & DELIVERY POLICIES:

We use a courier service to send your goods to you.

For mainland England, Wales and the Scottish Lowlands we operate a 48 hour delivery service although deliveries can often arrive within 24 hours.

For the Scottish Highlands, and non Mainland UK, it is a minimum two-day service. (Please note that in these areas delivery can take longer than the 48 hours, therefore we would suggest that customers choose from our non-perishable selections as we cannot guarantee that our refrigerated products would still be in optimum condition upon delivery).

Notice of damage to any goods received must be emailed through to websales@ultracomida.co.uk along with photos of damage to the outside packaging AND any damage to products for us to be able to investigate the matter.

We offer free delivery on orders of £120 or above for Mainland Wales, England and the Scottish Lowlands. The total price excludes any offers, vouchers or promotions.

As a user of our website, and when making a purchase from the Wine Club, you acknowledge that you do so under these terms and conditions. We hope you will agree that they are designed to be fair to you and to us. We may change these from time to time by updating this page.

1.    General

a.    Warranties: We warrant that the wines will be of satisfactory quality and fit for their general purpose.

b.    Order acceptance and the completion of the contract between you and us will take place on the despatch of the products ordered, unless we have notified you that we do not accept your order or you have cancelled your order. Title will pass on delivery of the products, provided that we have processed and received payment in full for the products.

d.    Availability - Wine is an agricultural product and runs out from time to time. We do not guarantee specific wines in the shipment you will receive but we do guarantee that the wine will always be of a similar value.

At Ultracomida, we aim to deal with all enquiries fairly, confidentially and quickly. We try to resolve most issues immediately, but where this is not possible; we will keep you informed about progress until a satisfactory resolution has been achieved.

2.    Age restriction

a.    By placing an order you also confirm that you are at least 18 years old.

b.    If you are buying a case of wine as a gift - the recipient must also be over 18 years old.

c.    If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID. If the person receiving the wine is unable to produce appropriate ID, unfortunately our couriers will be unable to leave the wine.

3.    Prices and payment

a.    All payments shall be received via direct debit to the value of £35.00 per month. Upon receiving £105.00 (after three months of payments), Ultracomida Trading Co Ltd will deliver your chosen case of wine between the value of £130.00 to £140.00. At this point payments will continue at the value specified above and the process shall repeat until you, the customer, or us, Ultracomida Trading Co Ltd cancel the arrangement.

b.    Where you enter into an agreement to be supplied with a regular delivery of wine or to make regular payments to your account you agree to us holding your payment details and charging your registered payment method as agreed. You also agree to us requesting updated details from your payment provider should the details of your payment method change and to charge the updated payment method in the same way as the original payment method. We reserve the right to take payment from another registered payment card if we fail to take payment from your default payment card or your default payment method has expired. This in no way restricts your rights to cancel.

c.    We reserve the right to terminate any Wine Club subscription at any time, without notice.

4.    Delivery and returns

a.    Where we deliver: We will deliver your wine to anywhere specified by the available destinations on this website. Delivery timescales:

                              i.        Please note that at certain times (such as Christmas and bank holidays) certain courier companies may place a one to two day delay on shipped goods due to high demand.

                             ii.        If you order 2 or more cases, they may not be delivered at the same time.

                            iii.        We aim to dispatch all orders within 2 working days. If we are unable to dispatch your order within 7 days, we will contact you with an estimated dispatch date and give you a choice of cancelling your order at that point.

                            iv.        We cannot be held responsible for the condition of the goods if no one is present at the delivery address. You are responsible for ensuring that the delivery address details are correct and that you have provided the correct postcode. Please see our delivery policy for further details.

                             v.        Our service does not require a signature to acknowledge delivery. A box is provided during the checkout process where you can tell us where to leave the goods if no one is at the delivery address at the time of delivery. If this information has not been provided, and the driver is unable to delivery the goods or if anything happens to the goods in this time it takes you to collect them from your safe place, we cannot be held responsible for the condition of the goods. You are responsible for ensuring that the delivery address details are correct, and that you have provided the correct postcode.

                              vi.        Our courier delivers only on working days Monday to Friday.

                            vii.        Maximum delivery weight is 30kg.

b.    Incorrect / missing or damaged products:

                                i.        In the event that any of the products in your order are incorrect, missing or damaged, please let us know within 24 hours after receipt. For corked wines, please let us know within 24 hours of opening the bottle. You will need to return the item in its original, complete packaging. If the item is not returned to us in its original condition we may refuse to accept the return. The original delivery documents will also need to accompany the goods, along with a receipt for the postage paid for returning the goods if we are to issue a refund. In the event of breakages we will refund all damaged items (Please note we will require photographic evidence of damaged goods). Please see our Contacts page for details on how to contact us. These terms do not affect your statutory rights as a consumer, or your right to return non-perishable goods under the Consumer Contracts Regulation.

c.    Cancellations:

                                i.        You may cancel your order for any reason whatsoever at any time up to 14 working days from the day after the date you receive your wine, provided all of the products are unopened and intact.

                               ii.        It is your responsibility to hold onto the wine and take reasonable care of it until we come to collect it. Once we have confirmation the case is collected we shall reimburse the price of the wine.

                              iii.        Any products collected by our carrier must be in their original box to avoid further breakages, where possible. If the packaging has become damaged or weakened the courier will not accept the package.

                              iv.        Once the wine has been delivered, in accordance with any specified delivery instructions, it becomes the recipient's responsibility.

                               v.        Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or inaccurately described goods. Further information about your rights is available from your Local Authority Trading Standards Department or Citizen's Advice Bureau.

                              vi.        For non-perishable goods you have a right to return them during the cooling-off period of 14 days, regardless of the condition of the goods. You will still need to follow the above requirements of returning the item in its original, complete packaging.

10. Security

a.    If you do not wish to set up your Wine Club direct debit using our website then we can set up your account over the phone. Call us on: 01970 626 008

b.    It is your responsibility to protect your password from being disclosed to any third party.

11. Intellectual Property Rights

a.    You agree and acknowledge that we own or are licensed to use all copyright, database rights, trademarks and other intellectual property rights in and to all parts of this web site, and to the business of Ultracomida Trading Co Ltd, the structure, design and layout of the web site.

b.    You are entitled to use our web site in accordance with these Terms and Conditions only. You must obtain our prior written consent before you use our web site or any part of it in any other manner.

c.    All persons, individual and corporate, are prohibited from providing hypertext or other links to the web site, other than to our home page, from their own web site or from a third party's web site, without our prior written consent.

d.    We reserve the right to make changes at any time to this website, these terms and conditions, our Privacy Policy and any other such policies of which we may inform you.

12. Limitation of Liability

a.    We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:

 .                loss or damage was not foreseeable to both parties when the contract was formed;

i.                loss or damage was not caused by any breach on the part of the supplier;

ii.                loss or damage relates to business and/or non-consumers.

b.    We will not be liable for loss or damage caused by the customer handling of our products. In particular we will not be liable for spillages or breakages.

c.    Customers should also be aware of the following inherent risks and warnings:

 .                Alcohol should be consumed in moderation.

i.                A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.

ii.                Red wine in particular may cause staining if spilt so extra care should be taken.

iii.                Sparkling wines and champagnes can be volatile due to the build-up of gases, extra care should be taken when opening these.
